Preamble
The Verlag für chemische Industrie, H. Ziolkowsky GmbH operates a homepage for commercial purposes under the domain http://www.sofw.com. The Verlag für chemische Industrie, H. Ziolkowsky GmbH offers customers books and magazines on these websites for sale via the Internet.
§ 1 Product selection
(1) The customer has the opportunity to select and order products on the above-mentioned website.
(2) With regard to each product, the customer will receive a separate product description on the respective website.
(3) The customer can click on the products he wants on the website. These are collected in a virtual shopping cart and the customer receives a compilation of the products at the end of his purchase at the total final price including VAT.
(4) Before sending the order, the Verlag für chemische Industrie, H. Ziolkowsky GmbH enables the customer to check the content of the order, in particular with regard to price and quantity, and to correct it if necessary.
§ 2 Orders – Delivery dates
We ask for online orders by stating the customer number (for new customers with the full name and address) as well as email address and telephone number for queries. The publisher cannot be held liable for incorrect deliveries caused by the customer due to incomplete information.
The publisher cannot guarantee a specific delivery date for new publications and new editions.
§ 3 Risk of dispatch – notice of defects
Our deliveries are only made against a fixed invoice and are at the risk of the recipient from the moment on. We do not provide compensation for lost or damaged shipments. Claims for damages for transport damage must be made exclusively to the post office, railway, freight forwarder or commission agent. Our invoice is considered accepted if the customer does not report existing defects within 8 days. In the event of a complaint, we ask you to provide the customer number, invoice number, type of shipment and contents. In all other respects, Section 377 of the German Commercial Code (HGB) applies.
§ 4 Prices
(1) The list prices at the time of the order as shown on the website apply.
(2) The prices are inclusive of VAT ex the registered office of Verlag für chemische Industrie, H. Ziolkowsky GmbH.
§ 5 Shipping costs
Our prices are ex publisher. Postage charges are at the expense of the recipient. Packaging will be invoiced at cost.
The amount of the shipping costs depends on the type and weight of the book and whether the delivery is made at home or abroad. You can see the shipping costs on the respective website.

Shipping costs for a SOFW-Journal trial subscription are already included in the price.
§ 6 Shop prices
By accepting the consignment, the reseller undertakes to comply with our fixed shop prices. We reserve the right to change prices. Publishers’ products exempt from fixed prices are marked on the invoice with *(= recommended retail price).
§ 7 Retention
of title All deliveries are made subject to retention of title in accordance with § 455 of the German Civil Code (BGB) with the following extension, to which the customer expressly agrees. All delivered publishing works remain the property of the publisher until payment of all deliveries – previous and future – and until all claims arising from the business relationship have been fully settled (current account reservation). They may therefore not be pledged or transferred. If a sale is made in the ordinary course of business before full payment has been made, the proceeds generated for this or the claim arising from the resale shall be transferred to the publisher.
§ 8 Special Regulations for Magazines
Cancellations must be received in writing by us at least 2 months before the end of a subscription year. Cancellations received later can only be considered at the end of the following subscription year.
§ 9 Copyright
All products of the publisher enjoy legal copyright protection. Reprints, reproductions and duplications of any kind as well as further processing for commercial purposes are only permitted with the prior written consent of the publisher.
§ 10 Returns
Returns or exchanges of permanently ordered works may only be carried out with the written permission of the publisher under deduction of a processing fee of 10% of the retail price of the returned work. The prerequisite is a perfect undamaged condition without price stickers. Unauthorised returns will not be credited. Returns are made at the expense and risk of the customer. No liability is assumed.
Always send returns sufficiently stamped and enclose the original invoice (delivery note) with the return. Returns sent freight collect cannot be accepted. We expressly reserve the right to charge you the additional costs incurred for this.
§ 11 Deliveries with Right of Return (RR)
As an exception, we ask you to invoice books that are fixed with the right of return (RR) exactly on the agreed date. If the deadline is exceeded, the shipment is considered to have been finally taken over and is due without further destination.
§ 12 Conclusion of Contract
The offers of the Verlag für chemische Industrie, H. Ziolkowsky GmbH on the website are subject to change. This means that Verlag für chemische Industrie, H. Ziolkowsky GmbH is not obliged to provide services in the event of unavailability. However, a contract and thus a contractual commitment for the individual services is concluded if the Verlag für chemische Industrie, H. Ziolkowsky GmbH has confirmed the customer’s order in text form.
§ 13 Payments
The invoice amount is payable free of charge without deductions until the due date specified on the invoice occurs. The invoice shall be deemed to have been paid upon receipt of payment by the Publisher.
You can choose between the following payments:
-Online payment by credit card
-Payment by bank transfer (after receipt of the invoice)
-Payment by direct debit (only possible for customers in Germany)
The contract and invoice currency is EUR.
In the event of late payment, reminder costs and default interest in the amount of 5% above the respective discount rate of Deutsche Bank AG will be charged from the date of the due date.
If the payment deadline is exceeded, all outstanding claims of the publisher become due immediately, regardless of previously granted payment terms.
§ 14 Warranty
Information, drawings, illustrations, technical data, weight, dimensions and performance descriptions contained in brochures, catalogues, circulars, advertisements or price lists are of a purely informational nature. We do not assume any liability for the accuracy of this information. With regard to the type and scope of the delivery, only the information contained in the order confirmation is decisive.
§ 15 Data protection/data security
We use the customer data provided by you (title, name, address, email address, telephone number, fax number, bank details, credit card number) in accordance with the provisions of German data protection law.
In addition, we use parts of the customer data provided by you (title, name, address, email address, telephone number, fax number, email address) for the purposes of direct advertising for our own similar goods, unless you have objected to this use at the time of notification or later.

Business-related data is stored by internal EDP (electronic data processing system).
For your security, we have encrypted the order process with SSL. Secure Socket Layer SSL is a protocol designed to enable secure data transmission over the Internet. Netscape or Microsoft browsers support this procedure. SSL uses the public key method, in which data encoded with a publicly accessible key can only be decrypted again with a very specific private key.
§ 16 Final Provisions
(1) The language of the contract is English.
(2) Should any provision of these Terms be or become void, the remainder of the Terms shall remain valid. The Verlag für chemische Industrie, H. Ziolkowsky GmbH and the customer shall replace the void provision with such an effective one that comes as close as possible to the will of the contracting parties from an economic point of view.
(3) Deviating terms and conditions of the customer, which we do not expressly acknowledge in writing, are not binding on us, even if we do not expressly contradict them.
§ 17 Place of performance and jurisdiction
The place of performance and jurisdiction for all claims of the publisher arising from all deliveries is Memmingen.
